This week an excellent article was published by Dr Michael Head – Associate Professor of Law at the University of Western Sydney – entitled, “Asylum seekers and ASIO’s abuse of power“. Dr Head sees Sheikh Mansour’s case as illustrative of the way in which our security organistion (ASIO) has become ‘legally unchallengeable’ – a situation that Professor Head describes as a ‘grave worry’.

Also in the news this week are two excellent articles from Press TV:

Yet the final word on the deportation must be given to Mansour’s family – both to his three sons who have been left behind, and to his faith community, who put together the second of these two videos:

It was an emotional time.  Indeed, I find it hard to watch the video coverage below without the tears welling up again.

The fight does not end here. The Australian Government has until Ocotber 21st to respond to the United Nations Human Rights Committee and explain why they charged, judged and executed Sheikh Mansour without ever telling him what he’d done wrong.

If you have any ideas as to how we can put pressure on the Australian government to respond to the United Nations, submit them to the Fighting Fathers Forum (nb. you’ll need to use VIP code ‘NO HOMERS’ to register).

The quote is with reference to the way the Australian government persuaded the United Nations to withdraw their request for a stay on the deportation of Sheikh Mansour Leghaei, on the basis that they are not actually breaking up his family.

The government claimed that because they had given visas to Mansour’s wife and youngest son that they were therefore not damaging the family unit. Hoever, in reality, the Sheikh and his wife and daughter will be forced to head back to Iran with Mansour, thus leaving three sons in Australia and breaking the family in half.

As the article also makes clear though, the United Nations is still pursuing the Australian government over concerns that Australia has violated fundamental human rights treaties to which it is signatory in the way it has treated Sheikh Mansour (eg. the right of every person to a fair trial). The government has been given until October 21st to respond to the United Nations’ concerns.  Read the full article here.

Another major media outlet to cover the Sheikh’s story is Al-Jazeera. As well as the clip displayed below, Al-Jazeera is considering a full-length documentary concerning the Sheikh’s treatment.

Greens Candidate for Grayndler, Sam Byrne, has condemned the Rudd Labor Government’s decision to deport Sheikh Mansour Leghaei.

“After 16 years in Australia, the Sheikh and his family are paying a terrible personal price for the government’s cowardice in the lead up to the Federal election,” Sam Byrne said.

“Labor’s desperation to pander to racism has led to this decision, in defiance of the United Nations Human Rights Committee, the International Covenant on Civil and Political Rights and any principles of natural justice.”

“Once again Labor is abandoning any principle. If they don’t stand for human rights, what do they stand for?”

“I call on the Government to reverse its decision, and at the very least release these secret old ASIO allegations against the Sheikh and give him a chance to respond.”

“Sheikh Leghaei has made a substantial contribution to multi-faith dialogue and our local community, and we will continue to support him.”

Also from the Greens:

1. Dale Mills writes in Green Left that the deportation of Sheikh Mansour is another instance of the Australian government silencing people it doesn’t agree with (click here).
2. Senator Scott Ludlam of the Greens has advised that he will ask questions on notice in parliament to the Minister for Immigration and to ASIO about Australia’s failure to respond to the UN’s request to put a halt to Sheikh Mansour’s deporation.
   

The Sheikh’s support team, when they announced their disappointment with the Minister’s decision, mentioned too that the United Nations Human Right Committe had already written to the Australian government, asking them NOT to deport Sheikh Mansour until they could take a good look at his case and assess whether his funamental human rights had been violated by the Australian government in the way they handled the case!

Thus far the Minister has shown no indication that he is considering complying with the UN’s request!

The article, Accusations Lost in Translation, chronicles a rather worrying list of accusations that have been made against the Sheikh – accusations that incriminate not only Mansour but his entire family.

Sheikh Mansour’s sister, for instance, is depicted as an agent of the Iranian government who walks the streets of Tehran with a walkie-talkie hidden under her veil, informing on women who dress immodestly. The detailed nature of the accusation would suggest that it must have some basis in reality, except that Mansour doesn’t have a sister!

Of course this is only one of a series of accusations about our Iranian Sheikh, but Feneley’s article brought to mind for me Anthonly Flew’s old dictum – that 100 leaking buckets hold no more water than one leaking bucket. Read it here.

The other news is that on Monday May 3rd Mansour was given yet another two week extension on his visa, to give more time to the Minister to make up his mind about his future. How long, O Lord, must we wait for justice?

And the good news is that Sheikh Mansour has now been given an extension on his visa until the Minister for Immigration has considered his appeal.  The extension currently takes him through to the middle of April 2010
